اخلاق و حقوق رقابت در صنعت داروسازی (Ethics and Competition Law in the Pharmaceutical Industry)

Persian abstract: صنعت داروسازي در هر نظام اقتصادي نقش مهمي ايفا مي كند. اين صنعت اگرچه واجد ويژگي هاي اقتصادي خاصي است اما مانند هر بخش اقتصادي ديگر، توليد و توزيع محصولات دارويي، تابع قواعد حقوق رقابت است. مقررات ناظر به رويه هاي ضد رقابتي يك جانبه مانند قيمت گذاري تبعيض آميز، قيمت گذاري تهاجمي، سوء استفاده از موقعيت مسلط، احتكار و استنكاف از معامله در كنار رويه هاي ضد رقابتي جمعي مانند تباني، قواعد مهمي از حقوق رقابت هستند كه در صنعت داروسازي نيز قابليت اعمال دارند.اگرچه وجود قوانين و مقررات رقابتي براي فعاليت در صنعت داروسازي ضروري است اما رعايت اخلاق داروسازي مي تواند از ارتكاب رويه هاي ضد رقابتي جلوگيري کرده و به عنوان عامل بازدارنده، نقش موثري داشته باشد. اين مقاله ضمن بررسي اعمال قواعد حقوق رقابت در صنعت داروسازي، رفتارهاي ضد رقابتي در اين صنعت را معرفي مي كند. بررسي نقش شوراي رقابت در نظارت بر صنعت داروسازي و نقش اخلاق حرفه اي در ممانعت از نقض حقوق رقابت در اين حوزه از جمله مواردي است كه در اين مقاله بر آن ها تمركز شده است.English abstract: The pharmaceutical industry plays an important role in every economy. Although the pharmaceutical sector has distinctive economic features, like every other sector of the economy, the production and distribution of pharmaceuticals must obey competition law rules.The provisions regarding unilateral anti-competitive conduct such as discriminatory pricing, aggressive price setting, abusing a dominant position and hoarding and refusal to inter into transactions as well as collective anti-competitive conducts such as collusion are some important competition rules which are applicable in the pharmaceutical industry.Although the existence of competition law and regulation is necessary for working in the pharmaceutical industry but pharmaceutical ethics can prevent committing the anti-competitive conducts and plays an effective role as a deterrent factor. This Article while reviewing the application of competition law rules in the pharmaceutical industry introduces the anti-competitive behaviors in this sector. We also focus on the competition council's function in monitoring the pharmaceutical industry and the role of professional ethics in preventing the violation of competition law in this sector.
